9-132.010 - Introduction

Section 302 of the Labor Management Relations Act (LMRA) (29 U.S.C. § 186) punishes the delivery and receipt, respectively, of things of value paid by employers and persons acting in the interest of employers to representatives of employees and labor union officials in industries covered by the Labor Management Relations Act (LMRA) (29 U.S.C. § 141, et seq.). The LMRA, sometimes referred to as the "Taft-Hartley Act," applies to all employees whose labor-management relations is subject to the jurisdiction of the National Labor Relations Board. (29 U.S.C. § 152, et seq.). Therefore, section 186 does not apply to labor-management disputes involving employees in the railway and airline industries [see Railway Labor Act at 9-139.103], employees of the Federal Government, and employees of state and local governments, or of corporations wholly owned by such governments (other than the United States Postal Service which is subject to the LMRA). 9-132.020 - Investigative and Supervisory Jurisdiction

Investigative jurisdiction lies with the Federal Bureau of Investigation and the Inspector General's Office of Investigations - Labor Racketeering and Fraud, United States Department of Labor, by reason of authority conferred on the Department of Labor investigators as Special Deputy United States Marshals.

The Labor-Management Unit of the Organized Crime and Gang Section, Criminal Division has supervisory jurisdiction over 29 U.S.C § 186.
