U.S. V. Mario Levis

In March 2008, Mario S. Levis, a/k/a “Sammy Levis,” was indicted on securities fraud and wire fraud charges in connection with a scheme to defraud investors and potential investors in the stock of Puerto Rico-based Doral Financial Corporation (“Doral”) that took place while Levis was the Treasurer and Senior Executive Vice President of Doral. The scheme, occurring between 2001 and 2005, involved the fraudulent manipulation of the publicly reported value of certain core assets of Doral in order artificially to inflate the market price of Doral’s common stock. Levis is expected to be arraigned in United States v. Levis, 08 Cr. 181 (TPG) on March 31, 2008 at 2:30 p.m. in Courtroom 26B, 500 Pearl Street, New York, NY 10007. The charges against Levis are merely accusations and he is presumed innocent unless and until proven guilty. Please be advised that Title 18, United States Code, Section 3771(a) provides as follows:

Rights of crime victims.—A crime victim has the following rights:

(1) The right to be reasonably protected from the accused.
(2) The right to reasonable, accurate, and timely notice of any public court proceeding, or any parole proceeding, involving the crime or of any release or escape of the accused.
(3) The right not to be excluded from any such public court proceeding, unless the court, after receiving clear and convincing evidence, determines that testimony by the victim would be materially altered if the victim heard other testimony at that proceeding.
(4) The right to be reasonably heard at any public proceeding in the district court involving release, plea, sentencing, or any parole proceeding.
(5) The reasonable right to confer with the attorney for the Government in the case.
(6) The right to full and timely restitution as provided in law.
(7) The right to proceedings free from unreasonable delay.
(8) The right to be treated with fairness and with respect for the victim's dignity and privacy.

Furthermore, Title 18, United States Code, Section 3771(e) defines a “crime victim” as “a person directly and proximately harmed as a result of the commission of a Federal offense . . . .” Please also be advised that the Court, in order to conduct orderly proceedings and to maintain a reasonable schedule, requires advance notice to be made to the United States Probation Department, in writing, from victims who wish to be heard during court proceedings such as sentencing. Based on the number of victims who provide such written notice, the Court will rule on the manner in which victims will be heard at such proceedings.

Arraignment took place on March 31, 2008.  The pretrial conference in U.S. v. Levis has been rescheduled from 5/1/08 to 5/19/08 at 4:30 p.m in Courtroom 26B, 500 Pearl Street, New York, NY 10007.
