  • Procedural Requirements, Entities Subject to the FOIA:  The court holds that “federal credit unions do not constitute ‘agencies’ for purposes of the . . .  [FOIA].”  “FOIA applies only to ‘agencies,’ which are ‘any executive department, military department, Government corporation, Government controlled corporation, or other establishment in the executive branch of the Government (including the Executive Office of the President), or any independent regulatory agency.’”  “[Defendant], like other federal credit unions, is a private cooperative association and does not fall within that definition.”
